01 About the Website

The Website is currently owned, managed and operated by MAG Estate Investments Ltd, (which term includes all subsidiaries of MAG Estate Investments Ltd) (" MAG Estate ", “ Company ”, " we ", " us " or " our "), in its capacity as development manager in connection with the Marsa Zayed development.

Marsa Zayed is a master-planned development in Aqaba, Jordan, being progressed through a partnership between MAG Estate and AD Ports Group. Individual projects within Marsa Zayed may be owned, developed and offered through separate legal entities, which will be identified in the relevant project information and definitive contractual documentation.

Nothing on the Website represents that MAG Estate independently owns or develops the entire Marsa Zayed master development or is the owner, developer or seller of every project displayed on the Website.

02 Acceptance and Changes

By accessing or using the Website, you agree to these Terms and Conditions and our Privacy and Cookies Policy . If you do not agree, please discontinue use of the Website.

We may amend these Terms and Conditions from time to time by publishing an updated version on the Website. The effective date shown above will indicate when the latest version took effect.

The Website provides general information about Marsa Zayed and its current and proposed projects. We do not warrant the accuracy, completeness or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.

The Website and its contents do not constitute:

• an investment prospectus, financial promotion or recommendation;

Masterplans, maps, drawings, renderings, images, videos, layouts, dimensions, specifications, amenities, landscaping, infrastructure, construction updates, anticipated completion dates, prices and availability shown on the Website are indicative only unless expressly stated otherwise in definitive contractual documentation.

The design, configuration, phasing, ownership and development structure of Marsa Zayed and its constituent projects may change. We may add, change, suspend or remove Website content at any time.

Reasonable efforts are made to keep information accurate; however, we do not warrant that all content is complete, current or error-free. Users should verify material information directly with the relevant project entity or its authorised representative before making any decision.

05 Expressions of Interest and Inquiries

The Website may allow you to submit an inquiry or register your interest in Marsa Zayed or a particular project. Submission of a form:

• does not create a contract or agency relationship;
• does not reserve or allocate any unit or property;
• does not give priority or any entitlement to purchase;
• does not guarantee that you will be contacted or offered any opportunity; and
• does not establish eligibility to acquire property in Jordan or elsewhere.

You must provide accurate and current information. We may refer your inquiry to the relevant project entity, sales team or authorised sales representative for follow-up in accordance with our Privacy and Cookies Policy .

06 Authorised Representatives

Only persons expressly authorised by the relevant project entity may provide official project or sales information. No statement made by a broker, sales representative or other person will amend or override definitive contractual documentation.

07 Intellectual Property

The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by MAG Estate, its licensors or other providers of such material and are protected by the Jordanian and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

These Terms and Conditions permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Website, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

You agree to indemnify MAG Estate, AD Ports Group, the respective project entities (and their affiliates and subsidiaries) against losses, liabilities and reasonable costs arising directly from your unlawful use of the Website, your material breach of these Terms and Conditions or your infringement of any third-party intellectual-property rights.

15 Governing Law and Jurisdiction

These Terms and Conditions and any non-contractual obligations arising out of or in connection with them or the Website are governed by the laws of the Hashemite Kingdom of Jordan. The competent courts of Jordan will have exclusive jurisdiction, subject to any mandatory law that applies otherwise.

16 General

These Terms and Conditions, together with the Privacy and Cookies Policy , constitute the entire agreement between you and MAG Estate solely in relation to your use of the Website. They do not amend, replace or form part of any reservation agreement, sale and purchase agreement or other definitive project documentation.

If any provision of these Terms and Conditions is held invalid or unenforceable, the remaining provisions will continue in effect. A failure or delay in exercising a right does not waive that right. These Terms and Conditions do not create rights in favour of any person other than the persons expressly protected by them.
